Aim2Be Privacy Information
This Privacy Notice provides a brief overview of our Privacy Information and our privacy practices. Please read the complete Privacy Information before accessing or using the App or our Health Services.
1. Scope and Application: The Privacy Information governs our collection, use and disclosure of your personal information when you use the Application or the Services.
2. Age Requirement: Children under the age of 13 can only use the Application and the Services with the consent of their parent or lawful guardian. If you are under the age of 13, you must have your parent or lawful guardian register for an Account for you.
3. Collection of Personal Information: We will collect personal information from you when you access or use the Application and the Services. We will collect certain information from you when you register for an Account, including your public display name, email address and month and year of birth.
4. Use and Disclosure: We will generally use your personal information for registration purposes and to provide the Application and the Services to you. We will only share your personal information in limited circumstances, such as when required by law or to investigate illegal or suspected illegal activities, where we have reasonable grounds to believe that there is a risk to the life, health or security of a user, and when you give us express permission to do so. We may also disclose anonymized information to our research partners for research purposes.

Before you submit any personal information to Ayogo Health Inc. (“Ayogo”) and Childhood Obesity Foundation (“COF”) (Ayogo and COF collectively, being the "Companies", “we”, “us” or “our”), please read this Privacy Information carefully. This Privacy Information governs the Companies' collection, use and disclosure of personal information through the Aim2Be Website and/or the Aim2Be App (such website and application, individually or collectively, is referred to as the “Application”), or otherwise through providing the Aim2Be Health Services (“Services”) provided by the Companies.
For the purposes of this Privacy Information, “personal information” means information about an identified or identifiable individual, excluding business contact information. “Personal health information” or “PHI” means information about an identifiable individual that relates to the individual’s physical or mental health. The Companies may collect personal information and PHI from you when you access and use the Application or the Services. By accessing or using the Application or the Services, you are agreeing to the terms of this Privacy Information.
Study Participants are users who receive access to the Application for a defined duration as part of an evaluation by the University of British Columbia. If you are a study participant, you will receive a separate consent form from the University of British Columbia and will be assigned a code to sign in. Your access to the Application will end 8 months after being enrolled and assigned a code to use the Application, unless you consent at that time to continue using the Application. You will be asked to agree to the Companies’ Terms and Conditions at the end of the study period, and if you accept the Terms at that point, you will have continued access to the Application. If you agree to these Terms after the study period has ended, your email address will remain on Ayogo Health Inc.’s (“Ayogo’s”) server. Any information you have provided up to this point will be retained, and Ayogo may continue to collect additional non-identifiable data. No further identifiable information will be collected, and the Application will not be able to access any personal data on your device. You may also delete your user account at any other time before or after the study ends. If you chose to delete your user account or do not agree to the Terms at the end of the study period, your email address will be deleted from Ayogo’s servers. If you do not continue using the Application at the end of the study period, you will be provided with a reactivation code. If at any time you wish you reactivate your user account, you may enter this code and your access to the Application will be restored, after agreeing to the Terms and providing your email address.
Personal Information Collected
Ayogo will collect information from you when you access or use the Application or the Services, including when you register for an account (“Account”) and create a profile with us. Ayogo will also collect personal information that you provide to Ayogo in connection with the Application or the Services and in correspondence with us.
Registration and Profile Information
When you sign-up for an Account and create a profile on the Application Ayogo will collect certain information from you, including:
• public display name
• email address
• Month and year of birth
Children under the age of 13 (“Child” or “Children”) can use the Application and the Services with the consent of their parent or lawful guardian. A Child’s parent or lawful guardian must register the Child for an Account.
As part of the registration process, Ayogo may ask the Child to provide certain information, including a parent or guardian’s email address. Ayogo may also ask the Child for their month and year of birth to validate their age.
Personal Health Information
COF’s coaches on the Application may collect your personal health information to provide you with advice about suitable activities, therapies and programs. Any PHI that is collected is de-identified and anonymized. Your PHI will not be used for any other purposes or shared with any other person.
When you use the Application or the Services, Ayogo may collect information of third-parties that you provide to us or authorize us to collect (“Third-Party Data”). You are responsible for obtaining the necessary consent for the collection and use of Third-Party Data and for the disclosure of this data to Ayogo.
Log and Website Information
Ayogo may automatically collect some information about your computer when you use the Application, including session data, computer operating system, and web browser software version. Ayogo may also collect information about your online activity in the Application, such as content viewed and pages visited, the frequency of your postings in the Forums, or your progress in any game.
• SAFEGUARDING YOUR PERSONAL INFORMATION
All collected personal information is stored in a Canadian cloud storage service using industry standard and organizational measures to prevent unauthorized or unlawful processing of personal data and accidental loss or destruction of, or damage to, personal data.
• COOKIES AND OTHER TECHNOLOGIES
(a) To help the Application recognize your browser as a previous visitor and save and remember any preferences that may have been set while your browser was visiting the Application.
(b) To help customize the content, website experience, and advertisements provided to you on the Application.
(c) To help measure and research the effectiveness of website features and offerings.
(d) To identify the device you are using to access the Application.
• ACCESS TO YOUR PERSONAL INFORMATION
You may contact Ayogo’s Privacy Officer at email@example.com to:
(a) For a nominal processing fee of $20 CAD, receive access to a digital copy of your collected personal information which will be provided to you by email.
(b) Request a correction be made to any inaccurate elements of your collected personal data.
• USE OF PERSONAL INFORMATION
Ayogo uses the information we collect about you for the following general purposes: for registration and to manage your Account, including to facilitate your access to and use of the Application or Services; to communicate with you in general, including to provide information about the Application or Services; to enable us to publish your reviews, forum posts, and other content to the Application; to respond to your questions and comments; to measure interest in and improve our products, services, the Application; to otherwise customize your experience on the Application; to solicit information from you; to resolve disputes or troubleshoot problems; to prevent potentially prohibited or illegal activities; to enforce our Terms; and as otherwise described to you at the point of collection.
• SHARING PERSONAL INFORMATION
The Companies may share your information:
With the appropriate government authorities where we have reasonable grounds to believe that there is a risk to the life, health or security of a user. For example, we may disclose your information to the appropriate government authorities in the event that a user discloses, or a coach observes, activities that present a concern for the safety or wellbeing of the user, such as mental health issues or physical or mental abuse.
In response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us.
When we believe it is necessary to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of the Companies, our users, or others; and in connection with our Application Terms and other agreements.
In connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy. Your personal information will be used and disclosed solely for the purposes related to the transaction and any such transfer will require the receiving entity to store and process the information in full compliance with our Privacy Information.
For data collected during the research study, Ayogo may share your data stripped of identifying information with the University of British Columbia via a secure VPN server.
Ayogo will not share your email address with any third parties nor display it in any public manner, except where you have given Ayogo express permission to do so.
The Companies may disclose personal information about a Child or a person under the age of 18 (“Youth”) to their parent or guardian if the Child or Youth discloses, or a coach observes, activities that present a concern for the safety or wellbeing of the Child or Youth, such as mental health issues or physical or mental abuse.
• CHANGES TO PRIVACY INFORMATION
We may change this Privacy Information in the future, and the changes will apply to all information we have about you. We will notify you of material changes to this Privacy Information by either sending a notice to the email address you provided to us, or by placing a notice on the Site.
